Terms of Use

The short version: These Terms are the rules for using MachineryList. The most important thing to know: we’re a marketplace that connects buyers and sellers of heavy equipment — we’re not part of the actual deal. We don’t own, inspect, or guarantee the equipment listed, and any purchase is between you and the other party, at your own risk.

1Acceptance of These Terms

MachineryList is operated by Machinery List LLC (“we,” “us,” or “our”) at machinerylist.com. By using the site, you agree to these Terms of Use and our Privacy Policy. If you don’t agree, please don’t use the site.

2What MachineryList Is — and Isn’t

MachineryList is an online marketplace and advertising platform. We give sellers a place to list heavy equipment and buyers a place to find it and get in touch. We are only the venue.

• We are not the buyer or seller in any transaction.
• We do not own, inspect, store, or ship the equipment.
• We do not take part in, guarantee, or process the payment or delivery for equipment sold between users.

Every sale, negotiation, payment, and delivery for equipment is strictly between the buyer and the seller. (Optional paid services we offer, such as featured listings, are covered in Section 5.)

3Listings and Content

• Sellers are responsible for their listings. The seller alone is responsible for the accuracy of every listing — including the equipment’s condition, hours, specifications, ownership, price, and their legal right to sell it.
• We don’t verify listings. We don’t independently confirm that equipment exists, is as described, or that a buyer or seller is who they claim to be.
• We can remove content. We may edit, refuse, or remove any listing or content at any time, for any reason, without notice.

4Buying and Selling — At Your Own Risk

Because we’re only the venue, you deal with other users at your own risk. Before you buy or sell, do your own homework — inspect the equipment, verify ownership and condition, confirm who you’re dealing with, and use secure payment methods. We strongly recommend inspecting equipment in person (or through a trusted inspector) before sending any money. We are not responsible for the conduct of any buyer or seller, or for any transaction that does or doesn’t happen.

5Paid Services and Fees

Most of MachineryList is free to use, but we may offer optional paid services — such as featured or promoted listings that give your ad more visibility. If you buy a paid service:

• The price and what’s included will be shown before you pay.
• Payment is handled through a third-party payment processor, and you agree to their terms as well.
• Fees are non-refundable except where required by law.
• A featured or promoted listing increases your ad’s visibility but does not guarantee a sale, a specific number of views or inquiries, or any particular result.

We may add, change, or discontinue paid services and their prices at any time.

6Your Account and Responsibilities

If you create an account, keep your login secure and provide accurate information. You’re responsible for everything that happens under your account. Tell us right away if you suspect unauthorized use.

7Acceptable Use

You agree not to:

• Post false, misleading, illegal, or fraudulent listings or information;
• List equipment you don’t have the right to sell;
• Harass, scam, or harm other users;
• Copy, scrape, or misuse the site or its content;
• Interfere with the site’s operation or security; or
• Use the site for any unlawful purpose.

We may suspend or close accounts that break these rules.

8No Warranties

The site and everything on it are provided “as is” and “as available,” without warranties of any kind, express or implied. We don’t warrant that listings are accurate, that the site will be uninterrupted or error-free, or that any buyer or seller will perform as expected. You use the site at your own risk.

9Limitation of Liability

To the fullest extent allowed by law, Machinery List LLC and its owners, employees, and partners are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising out of your use of the site or any transaction between users — including disputes over equipment, payment, condition, or delivery. Our total liability for any claim relating to the site will not exceed the greater of the amount you paid us in the past twelve months or one hundred dollars ($100).

10Indemnification

You agree to defend and hold harmless Machinery List LLC and its owners, employees, and partners from any claims, losses, or costs (including reasonable attorney’s fees) arising from your use of the site, your listings or content, your transactions with other users, or your violation of these Terms.

11Intellectual Property

The MachineryList name, logo, site design, and content (other than user listings) belong to us and are protected by law. You may not copy or use them without our permission. By posting a listing, you give us permission to display and promote it on and off our site.

12Third-Party Links and Services

The site may link to third-party websites or services we don’t control. We’re not responsible for them, and using them is at your own risk.

13Changes to the Site and These Terms

We may change, pause, or discontinue any part of the site at any time. We may also update these Terms; the updated version will be posted here with a new date, and continuing to use the site means you accept the changes.

14Termination

We may suspend or end your access to the site at any time, for any reason, without notice.

15Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Arizona, and you agree to that jurisdiction.
